Important Notice for U.S. Customers

Due to recent changes in U.S. trade regulations, imports from Canada are now subject to additional tariffs. As a result, all U.S.-based customers will be responsible for any applicable import duties, taxes, or tariffs imposed by U.S. Customs.

These terms of use are a legal agreement between us and describe the terms and conditions applicable to your use of our website and the services we offer, including the sale of products to consumers. You must read, agree with, and accept all of the terms and conditions contained in this agreement and our Privacy Policy.

It is your responsibility to ensure that your order contains acceptable and approved items for import into the country of destination. Buyers solely accept the full risk of any package being detained by customs and acknowledge they will not hold E.C.I. Networks liable for packages unable to be delivered.

Conduct & Use Limitation

You shall not carry out any act or omission which would:

• Disrupt, impair, or interfere with, alter or modify this website or its software
• Act in a way that affects or reflects negatively on us or anyone else
• Collect or attempt to collect information from others, including personally identifiable information, without prior consent
• Engage in activities that expose E.C.I. Networks or any third party to liability or adversely affect our name, reputation, or business
• Commit a crime or perform any act that may damage our network or systems
• Violate or attempt to violate the security of the website
• Cause any illegal, offensive, or defamatory material to be placed on or associated with this website
• Breach any copyright, trademark, privacy, confidence, or any other third-party right
• Create or procure software viruses, chain letters, unsolicited communications, or spam

Note: Violations of system or network security may result in civil or criminal liability.

Back Orders

Occasionally, a product you have ordered may be out of stock. If this happens, you will be emailed with the option to cancel or change your order. You must provide your email address when ordering. If you decide to wait, please be aware that delivery may take longer than the standard schedule.

Changes to Products & Terms

E.C.I. Networks may make changes to any products offered, or to the applicable prices, at any time without notice. The information provided with respect to products may be out of date, and E.C.I. Networks makes no commitment to update it.

Please check our Terms of Use periodically for changes, as we reserve the right to change the terms and conditions of sale at any time.

Custom Rights

• The customer who purchases the products is responsible for paying customs duties and any paperwork involved
• The price of the products sold does not include taxes (e.g., VAT)
• Customers are required to track their packages closely. If there is a delay, contact the courier or inform E.C.I. Networks immediately
• We will not be responsible or liable if a package is shipped back, damaged, or confiscated due to customs clearance issues. Please check your country's customs laws before ordering
• We will not be responsible for packages returned due to a failed delivery because the authorized receiver was absent
• The seller's responsibility ends when the product has been shipped to the address specified by the customer
• We will do our best to assist you if additional proof of sale or value is needed to clear customs

Payment & Security

Credit Card Security

All credit card numbers are encrypted in the software when the order is placed using 128-bit encryption. They are only decrypted after they reach our system and are not held in clear text on any website. We process payments through PayPal.

Currency

We currently accept CAD and USD. USD shall be accepted as the official currency for all calculations.

Damage or Declared Goods

Shipping companies such as FedEx will only cover the declared value stated on the invoice if a package is damaged in transit. We will not be held responsible if you have requested a change to the invoice value.

Safe & Secure Purchase

E.C.I. Networks uses PayPal for internet payment processing. PayPal stores credit card and bank account information only in encrypted form on computers not connected to the Internet, with physical, electronic, and procedural safeguards compliant with federal regulations.

Delivery

• We will endeavor to process your order within 1–4 working days upon successful payment confirmation. Delivery typically takes 3–30 business days after shipment, depending on the courier selected
• Only the authorized receiver shall be permitted to accept the delivery. E.C.I. Networks reserves the right not to release the delivery in the absence of the authorized receiver
• Due to unforeseen circumstances, slight delays may occur. E.C.I. Networks will not be liable for any loss caused by late or delayed delivery
• If your package is lost by the shipping courier and is uninsured, we will only replace the lost products up to the amount declared on the invoice

Missing Items: You are required to report any missing items within 24 hours of receiving your package. Requests made after 24 hours will not be entertained.

Disclaimer

This site is provided by E.C.I. Networks on an "as is" and "as available" basis. E.C.I. Networks makes no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content, materials, or products included on this site.

To the full extent permissible by applicable law, E.C.I. Networks disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Your use of the site is at your sole risk. This disclaimer does not apply to any product warranty offered by the manufacturer.

Governing Law & Jurisdiction

This website is owned and controlled by E.C.I. Networks Inc. with offices within the Province of Quebec, Canada.

By accessing this website, you agree that all matters relating to access to, or use of, this website shall be governed by the applicable laws of the Province of Quebec and of Canada, without regard to choice of law principles.

You submit to the exclusive personal jurisdiction and venue of the courts of the Province of Quebec or, where applicable, the Federal Court of Canada in connection with any dispute involving you, E.C.I. Networks Inc., or the website.

Language: The parties have required that this Agreement and all related documents be drawn up in English. Les parties ont demandé que cette convention ainsi que tous les documents que s'y rattachent soient rédigés en anglais. All rights not expressly granted within this Agreement are reserved by E.C.I. Networks Inc.

Liability & Indemnity

Limitation of Liability

E.C.I. Networks is not liable for any direct, indirect, special, incidental, or consequential damages arising out of the use or inability to use the products on this site, including loss of data or loss of profit, even if E.C.I. Networks was advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless E.C.I. Networks and its affiliates from and against any and all claims, damages, costs, and expenses, including attorney's fees, arising from or related to your use of this site.

In the event that you breach any of these terms, you will indemnify E.C.I. Networks, its subsidiaries, associated companies, employees, agents, professional advisors, suppliers, and affiliates against all damages, losses, claims, costs, charges, awards, orders, judgments, and other liabilities suffered as a result of that breach.

Linked Sites

E.C.I. Networks may contain links to other Internet sites. We do not assume any responsibility or liability for communications or materials available at such linked sites. These links are provided for your convenience only.

Severability

If any of these terms are held to be invalid or unenforceable, the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original, and the remainder of the terms shall continue in effect.

Orders & Cancellations

Making a Purchase

You are never under any obligation to purchase anything. To buy a product, click on it to add it to your cart, then proceed to Checkout where you will be asked for a few details to complete your order.

Non-acceptance of Order

Order acceptance and the completion of the contract will take place upon dispatch of the products ordered, unless we have notified you that we do not accept your order. Non-acceptance may result from:

• The product being unavailable in stock
• Our inability to obtain authorization for your payment
• The identification of a pricing or product description error

Order Cancellation

We will provide a full refund (less credit card transaction fees) if you cancel within 24 hours of order confirmation and prior to shipment. Cancellations made after 24 hours but prior to shipment will incur a 15% administrative fee in addition to the transaction fees. The remaining balance will be refunded.

Tax and Duty

Any taxes and import duties are not included in our pricing. Please check your government's policy on import duties and taxes before purchasing.

Modification

E.C.I. Networks reserves the right, at any time and without notice, to modify, suspend, or terminate operation of or access to the site, or to interrupt the site as necessary to perform routine or non-routine maintenance, error correction, or other changes.

Termination and Suspension

We may immediately issue a warning, suspend, or terminate your access and refuse our services without notice if: (1) you are in breach of any part of these terms; or (2) we believe your actions may cause legal liability for us, you, or any other user.

Out of Stock Policy

Scenario 1: All products were in stock when your order was confirmed, but one went out of stock after payment. In this case we will ship the in-stock products first and ship the out-of-stock item as soon as new stock arrives.

Scenario 2: The product was already out of stock when you placed the order. In this case we will ship all products together once the new stock arrives, though in some situations we may ship available items first.

Returns & Refunds

Returns and Cancellations Policy

All products are subject to a 7-day cooling-off period. You may return products within 7 days of delivery, without reason, as long as they are unused, unopened, and in the same condition as received.

Refund Policy

Refunds will be given at the discretion of E.C.I. Networks management.

Guarantee

Every effort is made to ensure your satisfaction. If you are not happy with our service or product, please contact us and we will do our best to resolve the issue.

Warranty Terms

We offer a lifetime warranty on all our fiber optic transceivers. E.C.I. Networks will assess a minimum of 20% restocking fees on any returned products. All shipping charges to return products to us are fully paid by you — we will not refund shipping costs. Please allow up to five (5) business days for our technician team to evaluate your returned products.

• If the products are found not defective, we shall return the products to you and you shall bear the shipping costs in addition to a testing fee of USD $25
• If the products are found defective, they will be repaired and shipped back to you. We shall not be responsible for products damaged during shipment or due to misuse by the customer or shipping carrier

Note: E.C.I. Networks is only responsible for warranty on products purchased directly from our website with an order number. If you purchased from a reseller, contact your reseller directly.

General

Relationship: Nothing in this agreement shall create or be construed to imply any agency, partnership, joint venture, employee-employer, or franchisor-franchisee relationship between you and us. Headings are for reference purposes only.

Intellectual Property: If you believe that your intellectual property rights have been infringed, email us at sales@ecin.ca. Only the intellectual property rights owner can report potentially infringing products.
